Revised bill aims to speed up Florida foreclosures

Florida has the nation's highest foreclosure rate. A proposed bill, if passed, would speed the backlog of pending foreclosures through the process a bit faster. The controversial bill originally made it to the Florida House last year, when struggling homeowners attempting to stop foreclosure protested against it. The revised bill is a more moderate version that may speed up some home repossessions from sitting in limbo for two or more years, the current average for foreclosures in Florida.

After a two-year stall in bank repossessions during the robosigning scandal during which many mortgage lenders were investigated for foreclosure fraud, home repossessions are now starting to pick up again; however, there are still many stuck in the system. Some lawmakers think the process should be cleaned up to allow them to go through more quickly.

Under the bill, lender paperwork would be strict and require banks to prove they have the right to foreclose on a property, which does give consumers a measure of protection against unlawful foreclosure. Condo associations would also be given the ability to foreclose quickly in the event a bank is being too slow. Some banks have been accused of saving costs through this practice, which adversely affects homeowners associations.

The bill is proving unpopular with many consumers who are still facing financial challenges and attempting to get back on their feet from debt, unemployment or other problems. Some would like more time to be able to catch up on their mortgage payments again.
